| CANCELLATION AND MODIFICATIONS FOR ANY REASON |
|
Notwithstanding any contrary provisions stated in the attached General Conditions, the present provisions concern the risks hereafter. Warranties are specified in the Particular Conditions

Article 1 : Coverage |
|
If the Insured must cancel his/her trip prior to the outbound departure, L'Européenne d'Assurances reimburses any deposit and other sums held and invoiced by the Operator as per its specific terms and conditions, less the excess quoted below.
If the Insured cannot travel owing to unexpected justifiable circumstances, L'Européenne d'Assurances reimburses the cancellation charges.
Unexpected circumstances mean any unintentional event on the part of the Insured or of a member of his travel party. The event, unforeseen at the time of booking, would have arisen from the sudden occurrence of an external cause.
In the event of damage, the benefit will be paid half in kind, half in GO VOYAGES travel vouchers.

Article 2 : Effective period of cover |
|
Provided the premium has been paid and the contract signed, and at the latest, on the day before the inception of cancellation penalties, the coverage becomes effective upon subscribing the present contract. It expires on the day of departure or of car-key delivery.
|
|
Article 3 : Limits of liability |
|
The cancellation charges are covered up to the overall limit shown on the table of benefits as stated in the Particular Conditions.
In no case will the benefit exceed 6,000€ net/person with a maximum of 30,000€ net by occurrence. This includes a maximum amount of 30€ per transaction in administration fee.
Neither the insurance premium nor the visa expenses are refundable.

Article 4 : Excess |
|
If, within the framework of this present contract, the Insured must cancel his/her trip on account of a disease, physical injury or death suffered by himself/herself or a family member, l'Européenne d'Assurances will pay an allowance less 30€/person excess.
For any other reason specified in the present contract, l'Européenne d'Assurances will indemnify the insured after deducting 20% of the total invoice. The minimum net excess per person is 75€.

Article 5 : Exclusions |
|
Beside the exclusions stated in the General Conditions, the cancellation cover does not apply in the following cases :
- any personal reason conflicting with the Insured's travel plans,
- warning issued by the French Ministry of Foreign Affairs against a particular destination,
- any event caused directly or indirectly by the Operator, in compliance with law n°92645 of July 13, 1992.

Article 6 : Traveller's liability in case of damage |
|
The Insured and his/her dependents must:
- notify the Operator or the supplier who has invoiced the service, as soon as the damage has occurred;
- in case of late notice, l'Européenne d'Assurances will only pay the part of the benefit effective on the date of cancellation;
- notify in writing l'Européenne d'Assurances, as soon as the damage has occurred and up to 5 working days at the latest. Passed this deadline, the Insured will be waived of his/her right of claim especially if, due to his/her late notice, l'Européenne d'Assurances has not been able to take the necessary action;
- attach any relevant document related to his/her claim with evidence and estimated harm incurred, including the Insured's latest salary slip.
In all cases, the Insured will be requested to present an original copy of each attachment. Whenever needed, medical certificates will be required. Failure to produce those will result in a suspension of the settlement.
L'Européenne d'Assurances reserves its right to claim the original unused travel ticket or the copy of the credit note issued by the airline.

| DELAYED FLIGHT |
|
Notwithstanding any contrary provisions stated in the attached General Conditions, the present provisions concern the risks hereafter. Warranties are specified in the Particular Conditions.

Article 1 : Coverage |
|
The cover applies to outbound and inbound flights :
- airlines' regular scheduled flights.
- chartered outbound flights with times printed on tickets.
If a flight is delayed by more than 4 hours, l'Européenne d'Assurances will pay up to the overall limit of 30€ net per person, plus a 30€ net benefit by additional two-hours. In no circumstances will the allowance exceed 150€ per person .
The cover does not apply if the Insured is reassigned to another airline maintaining the same schedule as the originally planned one.
The benefit is paid half in kind, half in GO VOYAGES travel vouchers.

Article 2 : Effective period of cover |
|
§ The coverage becomes effective on the date and time shown on the plane ticket. It expires upon arrival at destination.
|
|
Article 3 : Exclusions |
|
Civil war, riots, demonstrations, strikes, terrorist acts, highjack, sabotage, any radioactive accident, any nucleus-originated effect or any other ionising ray-related incident occurred in the outbound, transfer or inbound country.
- Any movement jeopardizing the safety of the trip as long as it has been warned against by the French Ministry of Foreign Affairs.
- A decision from airport or civil aviation authorities or from another authority having then announced at least 24 hrs before the departure date.
- Missed flight departure for whatever reason.
Denied boarding resulting from a late show at checkpoint or delayed baggage check.

Article 4 : Obligations in the event of a disaster |
|
The Insured or his/her beneficiaries must :
file a claim or have a representative from the airline or airport present written evidence of the delay;
address the claim to l'Européenne d'Assurances within 15 days following return, and enclose the airline ticket with its invoice and boarding pass.
Failure to present above documents will result in the immediate suspension of the claim.

| PERSONAL ASSISTANCE |
Notwithstanding any contrary provisions stated in the attached General Conditions, the present provisions concern the risks hereafter. The warranties are specified in the Particular Conditions.
In order to be entitled to the warranties below the Insured must contact l'Européenne d'Assurances at the time of the accident. Only the file number delivered will justify an assumption of responsibility |

Article 1 : Definitions |
|
- L'Européenne d'Assistance : the assistance division of l'Européenne d'Assurances.
- Home : the insured's usual place of residence, in Metropolitan France including Corsica and Monaco, Switzerland or one of the EU countries.
- Family members : spouses by right or fact, ascendants or descendents down to the 2nd degree, parents-in-law, sisters-/brothers in law, sons-/daughters in law , step-parents, step- sisters-/brothers, step- sons-/daughters.
- Critical illness : any deterioration in health condition diagnosed by a competent medical advisor and resulting in the suspension of a professional or regular activity and appropriate medical treatment.
- Severe physical injury : any accidental bodily injury caused by the sudden occurrence of an external event, so diagnosed by a competent medical authority, resulting in the suspension of a professional or regular activity and impairing any trip. |

Article 2 : The Insured is either ill or suffers from a bodily injury |
|
The medical team of l'Européenne d'Assistance contacts the local physician or the insured's family doctor in order to intervene under the conditions best suited to the patient's condition.
The medical team of l'Européenne d'Assistance makes arrangements for transportation to a medical facility near the Insured's home or to a more appropriate specialized hospital (depending on the severity of the case, the evacuation will be made by train, sleeping car, ambulance, air carrier or air ambulance).
The medical advisors of l'Européenne d'Assistance are the only body entitled to make a decision as to the repatriation issue, its location and its means. Bookings will be made through l'Européenne d'Assistance.
L'Européenne d'Assistance will transport the Insured back home once he/she has been deemed to leave the medical care facility.
If the patient's condition requires it, l'Européenne d'Assistance organizes and pays for a member of the travel party to escort the patient.
If the health condition of the Insured justifies neither repatriation nor hospital confinement, yet if the Insured cannot return on the previously scheduled date, l'Européenne d'Assistance will pay for the cost of an extended hotel stay for the Insured and his/her attending companion: up to 50€ per night and per person (meals exclusive) with receipts, until repatriation. The duration of this warranty cannot exceed ten nights.
When the patient's health condition permits, l'Européenne d'Assistance organizes and pays for the return of both the patient and his/her attending companion.
If, the Insured, confined in a hospital, is not eligible for immediate repatriation, l'Européenne d'Assistance makes lodging arrangements for a visitor to be at his/her bedside. It will pay for the cost of incidentals up to 50€ per night, upon receipts, until the evacuation of the Insured. L'Européenne d'Assistance pays for the return of the attending visitor if he/she cannot use the planned conveyance - if the hospital confinement exceeds seven nights and if none of the travel party can stay near the patient, l'Européenne d'Assistance will issue a round-trip ticket for a person designated by the Insured to come by his/her bedside, provided the outbound country is a EU country or Switzerland. Hotel accommodation will be arranged and paid for, up to 50€/night, upon presentation of a receipt, meals exclusive. The duration of the warranty cannot exceed 10 nights.
- When the Insured's health condition allows it, l'Européenne d'Assistance makes arrangements and pays the cost of repatriation for both the Insured and his/her attending companion.
- When the Insured's health condition does not permit him/her to take care of his/her minor children and when he/she is not accompanied by any other member of his/her family, l'Européenne d'Assistance pays for transporting a relative back home with the children.

Article 3 : In the event of death |
|
L'Européenne d'Assistance makes arrangements and pays for the transportation of the corpse from the burial location to one of the EU countries or Switzerland. Funeral expenses including the cost of a standard coffin are covered up to an overall net limit of 1,200€ .
L'Européenne d'Assistance makes arrangements and pays for the return of the family members covered by the contract.

Article 4 : Additional personal assistance |
|
Early return : if the Insured has to curtail his/her trip for the following reasons :
- death of a family member, of the person in charge of the custody of his/her minor and handicapped children, or of a business partner,
- hospitalization of spouse (by fact or law), first degree descendents or ascendants, remained in the originating European country because of a critical sickness diagnosed by a physician from l'Européenne d'Assistance,
- catastrophes resulting from fire, explosion, theft or natural occurrences in the Insured's usual or second home, or in his/her office premises, and requiring his/her urgent return, l'Européenne d'Assistance makes arrangements and pays for the Insured's return to his home country. If time permits and if his/her presence is required for ensuring the continuation of the trip, l'Européenne d'Assistance makes arrangements and pays for the insured's return to the location where he/she can meet his/her party.
Repatriation or transportation of other insured members of the travel party : if, following the Insured's evacuation, the other insured members in his/her travel party ask to be sent home, l'Européenne d'Assistance makes arrangements and pays for their repatriation.
Medical expenses : l'Européenne d'Assistance complements reimbursement by Social Security or any other Medicare organization, and pays physician-ordered pharmaceutical, surgical and/or hospital costs sustained by the Insured away from his/her home country, up to the limit below, per trip :
- USA - Canada - Asia - Australia: 25,000 € net
- other countries: 5,000 € net
- excess, irrespective of the country: 50 € net.
Besides, if, while away from his home country, the Insured cannot afford the medical expenses incurred by a sudden illness or bodily injury during the period of coverage, l'Européenne d'Assistance may make an advance payment within the limitations of its policy, in exchange for a cheque of a pre-estimated value. This cheque will be returned against receipt of the notification of payment by Social Security or by another MediCare organization. The Insured will be requested to justify his/her debt abroad.
This coverage ends once l'Européenne d'Assistance has successfully performed repatriation.
Illness or bodily injury suffered by one of the insured's minor or handicapped children remained in the home country. If while on his/her trip, one of the insured's minor or handicapped children suffers from illness or bodily injury, l'Européenne d'Assistance pays for transportation to the most appropriate hospital priorily approved of by the Insured. L'Européenne d'Assistance ensures the child's repatriation and will keep the Insured informed of the child's condition, if he/she has left a forwarding address. If the Insured's presence is required, l'Européenne d'Assistance ensures his/her return home.
Shipping of medication : l'Européenne d'Assistance pays for any investigation and dispatching means to ship the physician-ordered medication if it, or its equivalent, are not locally supplied. However, the cost of the medication will be charged to the Insured.
Forwarding of emergency messages : l'Européenne d'Assistance will forward the messages addressed to the Insured when he/she cannot be reached directly. Also, l'Européenne d'Assistance can pass on an urgent message from the Insured to a member of his/her family.
Legal assistance : l'Européenne d'Assistance will pay for legal fees up to a maximum of 1,500€ net, if the Insured needs to respond to any legal action taken against him/her, and provided that the facts he/she is accused of are unlikely to bring about a legal sanction in the host country. If the bail has been reimbursed to the Insured by the local authorities before that deadline, it must be paid back to l'Européenne d'Assistance. This warranty does not apply to business related affairs or to the keeping or use of a motor vehicle.
Advance of bail : If the Insured has inadvertently broken the local law, l'Européenne d'Assistance will bail him/her out up to 8,000€ net. The bail must be paid back within the month following the notification received from l'Européenne d'Assistance.

Article 5 : Limitation of liability |
|
L'Européenne d'Assistance strictly intervenes according to the laws and regulations, both national and international. Its actions are subjected to prior approval by the competent authorities.
L'Européenne d'Assistance cannot be deemed liable for any delay or prevention in the execution of services in the event of strikes, riots, manifestations, restriction on freedom of movement, sabotage, terrorism, civil or foreign war, radiation effect or any other fortuitous or "force majeure" case.
The services performed during the trip or those not covered by l'Européenne d'Assistance are not eligible.
l'Européenne d'Assistance determines the type of ticket allowed to the Insured, which depends on the availabilities of the carrier as well as on the duration of the journey.
If the Insured resides outside of a EU country or in Switzerland, and upon his/her very request, l'Européenne d'Assistance may transport him/her back home or to the nearest best equipped specialized medical facility. In such a case the Insured will pay for the cost difference between repatriation to metropolitan France and his/her home country.
The warranty becomes effective on the day of outbound departure and ends on the return date shown on the transaction form : the journey cannot exceed 90 days.
In case of damage, l'Européenne d'Assistance's maximum allowance is 155,000 € net per person.
Medical expenditure: USA, Canada, Asia, Australia: 25,000€ net per person up to a maximum of 250,000€ net per occurrence. Occurrence means any event with subsequent damages eligible to one or several sections of coverage (one or several warranties in the contract).

Article 6 : - Exclusions |
|
Beside the exclusions stated in the General Conditions, l'Européenne d'Assistance cannot be held liable in the following cases :
epidemics, pollution, natural disasters,
convalescence and current non-consolidated medical ailments under treatment,
psychological, mental or nervous disorders,
minor physical disorders or injuries that can treated locally and do not prevent the Insured from pursuing his/her journey,
expenses related to a spa or beauty treatment, vaccination, prothesis, dental equipment, eyeglasses, contact lenses,
expenses that have already been approved of by l'Européenne d'Assistance ,
telephone calls other than those passed to l'Européenne d'Assurances call center.

Article 7 : Traveller's liability in case of damage |
|
To request assistance :
In order to be eligible to the aforementioned coverage in the event of damage, the Insured must, upon occurrence, contact l'Européenne d'Assistance's call center. The reference he/she will be given will be needed to claim coverage.

The Insured must specify his/her contract number, the nature of complaint, and his/her forwarding address. The Insured must also authorize any medical advisor from l'Européenne d'Assistance to access the information regarding the patient.
To claim reimbursement, The Insured must :
- keep l'Européenne d'Assistance informed within five working days. Over this deadline, the Insured may be denied his/her right to benefit.
- attach the following documents to his/her claim :
- his/her insurance certificate with his/her claim reference number,
- the medical certificate specifying the nature of the ailment with its date of occurrence. (important: failure to document the claim will stop the investigation process).
- the death certificate,
- itemized statements from Social Security and any other MediCare organization, with copies of receipts or expense records,
- any additional document needed for the instruction which would be requested by l'Européenne d'Assistance,
- If l'Européenne d'Assistance has already paid for transporting the Insured, the unused portion of the travel ticket must be turned in.

| BAGGAGE |
|
Notwithstanding any contrary provisions stated in the attached General Conditions, the present provisions concern the risks hereafter. Warranties are specified in the Particular Conditions.

|
Article 1 : Coverage |
|
L'Européenne d'Assistance covers the Insured's baggage worldwide, outside of his/her usual or second home, up to 800€ net per person, against the following damages :
- theft,
- total or partial destruction, including that resulting from natural disasters,
- loss by a certified conveyor.
Baggage means travel bags, suitcases, objects and personal belongings except for the clothes worn by the Insured.
The valuables mentioned below are covered up to 50% of the guaranteed capital and only in the following conditions :
- guaranteed pieces of jewellery, precious metal objects, pearls, hard stones and watches, only if they have been deposited into the hotel safe or worn by the Insured,
- photo, video audio and recording devices and equipment, films with their accessories, insured furs and fine leather clothes worn by the Insured.
Belongings purchased during the trip are covered up to 25% of the insured capital.

Article 2 : - Effective period of coverage |
|
The coverage becomes effective at baggage check-in or upon receiving the rented car keys. It ends upon arrival at return destination or upon returning the car keys.

Article 3 : Calculation of benefits |
|
The allowance is calculated on the basis of the replacement value at the date of damage minus wear and tear, without applying the standard ratio by the Code of Insurance. Benefits are not cumulative with those of the conveyor.
|
|
Article 4 : Excess |
|
In all cases, l'Européenne d'Assistance will indemnify the Insured minus an excess of 40 € net by person.
|
|
Article 5 : Exclusions |
|
Beside the general exclusions, the following are not covered :
- shopping items, cash, credit cards, debit cards, travel tickets, electronic appliances, alarms, electronic games and their accessories, travellers cheques, pens, lighters, video tapes and films, documents and vouchers of all kinds, pieces of collections and professional equipment, keys, bicycles, towels, caravans, hauling equipment, eyeglasses, contact lenses, prostheses, any type of medical equipment, medication, perishables,
- theft of unattended baggage, i.e. luggage left in a unattended public place or in a unlocked car visible from the outside,
- theft without burglary or with the use of false keys,
- theft of the Insured's baggage left in a vehicle between sunset and sunrise or in a convertible,
- indirect consequential damage like denied use or parking ticket,
- damage resulting from defaulted manufacturing or natural wear and tear,
- a lost, forgotten or swapped object,
- sports equipment,
- theft on camping ground,
- damage in a guaranteed baggage caused by smoking, floods or leak of oily or corrosive materials or colouring materials.

Article 6 : Limitations of Warranty |
|
In all cases, our maximum coverage at l'Européenne d'Assistance will not go beyond the benefit quoted in the Particular Conditions, with a net maximum of 80,000€ per occurrence.
Occurrence means any event with damageable consequences likely to entail one or several claims for coverage. |

Article 7 : Traveller's liability in case of damage |
|
Under penalty of forfeiture and except for unexpected or "force majeure" events, the Insured is bound to respect the following obligations.
In the event of loss or deterioration of baggage entrusted to a conveyor, or of a theft in a hotel, he/she must have an accredited representative of the conveyor or the hotel (not of the Operator) draw up an official report regarding the damage suffered. Failure to present such a report will entail a penalty equal to the sum l'Européenne d'Assurances is eligible to cash as a recourse against the conveyor or the hotel.
In the event of a theft, the Insured must lodge a claim with the nearest police authorities. He/she must inform l'Européenne d'Assurances in writing, within the next five working days following the offence (period shortened to two working days in case of theft). Over this time span, the Insured will lose his/her right of claim if because of the late notification, he/she has harmed l'Européenne d'Assurances.
- Address original evidence documents to l'Européenne d'Assurances, i.e.
- a proof of the claim deposit including the conveyor's provisions (exceed), whether by sea, air or road,
- the report of damage,
- detailed itemized inventory,
- a report of damage of irregularity, ticket of transport, or baggage check-in if needed,
- the estimate of repair, or discharged invoices, purchase invoice or certificate of origin.
- If the Insured retrieves part or all of his/her stolen or stray belongings, and whenever, he must immediately inform l'Européenne d'Assurances.
- If the recovery takes place before the allowance has been paid, he/she must take them back into his/her possession and l'Européenne d'Assurances will compensate for any possible deterioration.
- If the recovery takes place after the payment of the allowance, he/she will have 2 weeks to decide whether he/she will take his/her belongings back against refunding the allowance received, minus deterioration and missing articles' costs. The Insured has 15 days to decide. At the end of this time span, l'Européenne d'Assurances will deem that the Insured has chosen renunciation.
- The damaged items which have been indemnified become the property of l'Européenne d'Assurances.

| GENERAL EXCLUSIONS |
The warranty of l'Européenne d'Assurances does not apply in the following cases :
- use of drugs, narcotics and medication not medically prescribed,
- alcoholism intentional acts, conscious inobservance of official prohibitions,
- suicide or suicide attempt, self-mutilation,
- handling or detention of weapons, guns and rifles including shooting arms,
- participation in bets, crimes, brawls (except in self-defence events),
- deliberate harmful acts caused by the Insured, directly or indirectly,
- any "force majeure" event, preventing the execution of the contract, especially prohibited acts decided by local, national or international authorities,
- civil or foreign war, riots, movements, strikes, acts of terrorism, sabotage or whatever demonstration of the radioactivity,
- epidemics, pollution or natural disasters,
- accidents resulting from the practice of sports by the Insured in the framework of an official competition organized by a sports federation and for which a specific licence is required,
- mountain hikes, bobsleigh, hunting of wild animals, air sports, skeleton, speleology and off-piste skiing.
OMBUDSMAN SERVICE : La Compagnie Européenne d'Assurances adheres to the mediation policy implemented by the professional insurance organizations which can be freely accessed in view of reverting to amicable settlements in litigations between the insurers and their policy holders.
